Terms of Service

1. Who can use poggers.fun

• You must be at least 18 years old and able to enter a binding agreement.
• You may not use the Site if you are located in, or a resident of, a country or region under comprehensive sanctions (for example by the U.S. Treasury's OFAC), or if you are on any sanctions list.
• You may not use the Site where memecoins, crypto trading or this kind of service is illegal. You are responsible for following the laws that apply to you, including taxes.

2. What poggers.fun is

• The Site is a website interface to a smart contract on the Solana blockchain (program GaX6m1jHeCZHKFnQd9QqBk7ab3WquHE16yJEeqCC6XUX). The contract, not us, executes launches, trades, fee payments and payouts.
• Non-custodial. We never hold your funds, tokens or private keys. You sign every transaction yourself in your own wallet.
• Transactions are final. Blockchain transactions can't be reversed, cancelled or refunded by us or anyone else.
• The contract is upgradeable by its owner, and some settings (such as fees) can be changed within limits written into the contract. See How it works.

3. Coins and games

• Each Steam game can have one coin. Coin names and images come from Steam's public store data and are locked.
• Coins are memecoins. They have no intrinsic value, grant no rights, revenue share, ownership or claim of any kind in any game, studio or in poggers.fun, and are not offered as investments. Don't buy them expecting a profit.
• No affiliation or endorsement. poggers.fun is not affiliated with Valve, Steam or any game developer or publisher. A coin existing for a game does not mean that game's studio created, endorses or supports it, unless the coin page shows the studio as verified.
• Anyone can launch a coin. We don't vet launchers and aren't responsible for what other users do.

4. Fees

• Every buy and sell carries a 2% fee: 1% to the game's studio vault, 0.8% to poggers.fun, and 0.2% to the coin's launcher.
• For the first 20 seconds after a launch, an extra anti-sniping fee of up to 20% applies, falling to zero; it goes to the studio vault.
• Traders who joined with an affiliate code pay 10% less of the poggers.fun fee, and the affiliate receives 30% of it. These come only out of the poggers.fun share.
• Studio fees not claimed by a verified studio within about 12 months may be used by the contract to buy back and burn that coin.
• You also pay Solana network fees and account rent, which go to the network, not to us.
• Fees may change, within the hard caps in the contract. The fee shown when you trade is the one that applies.

5. Studios

• A game's developer can claim the studio fees by proving control of the game's official Steam announcements or website. Claims are subject to a security delay, during which we may cancel a claim we believe is fraudulent.
• You may only register as a studio for a game you are authorised to represent. False claims are prohibited and may be reported to the authorities.
• A verified studio may withdraw its fees, transfer its claim, or opt out, which stops new buys of its coin.

6. Affiliates

• Affiliate codes are permanent, and referrals are recorded on-chain. Payouts are made automatically by the contract.
• Don't promote poggers.fun with spam, misleading claims, promises of profit, or by pretending to be a studio or us.

7. Risks you accept

• Memecoin prices are extremely volatile and can go to zero. You could lose everything you put in.
• Smart contracts can have bugs. The poggers.fun contract has been tested but, as of the effective date above, has not had an independent security audit.
• Blockchains, wallets and websites can fail, be congested, attacked or go offline. Others may trade ahead of you, and prices may move before your transaction lands.
• Laws and regulations about crypto may change and could affect poggers.fun or your ability to use it.
• You are solely responsible for your wallet, keys and seed phrase. We will never ask for them.

8. What you may not do

• Manipulate markets, including wash trading, spoofing or coordinated pump-and-dump schemes.
• Use the Site for fraud or scams, or to launder money or finance illegal activity.
• Impersonate a studio, poggers.fun or anyone else.
• Exploit bugs, attack or overload the Site or contract, or scrape the Site in ways that harm it. If you find a bug, please report it to Alexanderataylor@icloud.com.
• Break any law or sanction, or infringe anyone's rights.

9. Names, art and takedowns

• Game titles, logos and images are the property of their owners. They are shown only to identify which game a coin refers to.
• If you own a game or its rights and want its coin removed from the Site, or believe the Site infringes your rights, email Alexanderataylor@icloud.com with your details, the game and the request. We can remove a coin from the Site's interface. Coins on the blockchain itself can't be deleted by anyone.
• The poggers.fun name, Site design and code are ours.

10. No advice, no warranty

• Nothing on the Site is financial, investment, legal or tax advice.
• THE SITE AND CONTRACT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PURPOSE AND NON-INFRINGEMENT.
• TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, TOKENS OR FUNDS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE POGGERS.FUN FEES YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM OR US$100.
• You agree to indemnify us against claims arising from your use of the Site or breach of these terms.

11. Changes and access

• We may update these terms. The date at the top will change, and continued use means you accept the new terms.
• We may restrict or end access to the Site, for anyone, at any time, for example to comply with the law. This doesn't affect tokens you hold on the blockchain.
• If any part of these terms is unenforceable, the rest still applies.
